AI 2nd Line Terms of Service & End User License Agreement

Version 2026-10-11 · Effective October 5, 2026

These terms are a legal agreement between you and EString Software Corporation ("we", "us"), the provider of AI 2nd Line. By creating an account, accepting these terms in the app, or using the service, you agree to them. If you do not agree, do not use the service.

Read section 4 in particular. Your calls and texts go out over a carrier registration that belongs to us and is shared with our other customers. What you send affects them, which is why the rules in section 5 are strict and enforced immediately.

1. Who may use AI 2nd Line

You must be at least 18 and able to form a binding contract. You must not be barred from receiving telecommunications services under applicable law, and must not be listed on any government denied-party or embargo list. One account per person or business entity; you are responsible for everything done under your account, including by anyone you give access to.

2. The service

AI 2nd Line provides a second phone number with an AI assistant that answers, screens, and places calls and sends texts on your behalf, plus an API that lets software you authorize do the same.

Phone numbers are leased from carriers, not sold to you. You do not own a number assigned to your account. Numbers remain subject to carrier and regulatory rules, may be reclaimed if your subscription lapses, and a released number cannot be recovered — by us or by anyone. Number portability out is not guaranteed and depends on the carrier.

3. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the AI 2nd Line app on Apple-branded devices you own or control, as permitted by the App Store Terms of Service, and to use the service for your own calls and texts. You may not sell, rent, sublicense, resell or redistribute the service or access to your number, reverse-engineer the app, or use it to build a competing service. This license ends when your account does.

4. Your number runs on our carrier registration

This is the part most people don't expect, so it is stated plainly.

In the United States, application-to-person messaging must be registered with the carriers under a framework called A2P 10DLC. That registration — the brand, the campaign, and the trust score attached to them — is held by us, not by you. The same is true of the carrier relationships that let your calls connect and display properly. When you or your assistant sends a text or places a call, it leaves on our registration and carries our reputation.

Three consequences follow, and by using the service you accept all three:

Our telecommunications providers' own acceptable-use and messaging policies — including the CTIA Messaging Principles and Best Practices — apply to your use of the service, and nothing in these terms permits what they prohibit.

5. Acceptable use

You must follow the Acceptable Use Policy, which forms part of these terms and may be updated to track carrier and regulatory requirements. In summary, and without limiting it:

We may suspend or terminate immediately, without refund, for breach of this section.

6. AI calls, recording, and disclosure

Your assistant speaks with an artificial voice. That has legal consequences you are responsible for meeting:

7. Automated access and the Agent API

AI 2nd Line can issue you an API key that lets software — including AI agents you or others operate — place calls and send texts from your number. The key is a credential, not a separate account, and everything done with it is treated as done by you.

8. Your content and your contacts

You keep ownership of your content. You grant us the license needed to run the service — transmitting your calls and messages, transcribing them, generating replies, and storing them for you — as described in the Privacy Policy. If you sync contacts, you confirm you are entitled to share those details with us for that purpose.

We do not sell your data and do not use it for advertising. Our AI vendors are contractually barred from training on it.

9. Subscriptions, minutes, and billing

Plans are sold through your Apple ID and renew automatically until canceled in your device settings; cancel at least 24 hours before a renewal to avoid being charged for the next period. Plans include a monthly allowance of AI talk-time minutes. When the allowance is exhausted, AI answering falls back to voicemail until renewal or until you buy a top-up. Purchased top-up minutes roll over while your subscription remains active and are forfeited if it lapses.

Payment, refunds and billing disputes are handled by Apple under the App Store Terms of Service. We cannot issue refunds for App Store purchases. Minutes and numbers have no cash value.

10. Suspension and termination

You may stop using the service at any time; cancel the subscription through Apple and use the contact form to delete your account. We may suspend or terminate your account, a number, or an API key:

Termination for breach does not entitle you to a refund. On termination, numbers assigned to your account are released and cannot be recovered.

11. Indemnity

You will defend, indemnify and hold harmless EString Software Corporation, its officers, employees and suppliers against any claim, loss, fine, penalty, fee or expense (including reasonable legal fees) arising out of:

This obligation survives termination of your account.

12. Emergency services

AI 2nd Line is not a replacement for your primary phone service and must not be relied on to reach emergency services. Calls to 911 from a AI 2nd Line number may not connect, may not convey your location, and will not work if your device has no data connection or if the service is unavailable. Keep a working traditional phone or mobile service for emergencies.

13. The assistant can be wrong

The assistant is an AI system. It can mishear, misremember, invent details, and misjudge who it is speaking to. Verify anything important before acting on it. You are responsible for the instructions you give it, for the knowledge you load into it, and for what it says and does on your behalf. Do not use it where a mistake would cause harm — including medical, legal, financial or safety-critical advice.

14. Warranty disclaimer and limitation of liability

The service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that calls or messages will be delivered, that the service will be uninterrupted, or that the assistant will be accurate.

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for all claims in any twelve-month period is limited to the amount you paid us in that period. Nothing here limits liability that cannot be limited by law. Your indemnity under section 11 is not subject to this limit.

15. Changes

We may change these terms. When we do, we raise the version number at the top of this page and ask you to accept the new version in the app. Material changes take effect for you when you accept them; continuing to use the service after being asked, without accepting, is not permitted and the assistant will not run. The Acceptable Use Policy may change on shorter notice where a carrier or regulator requires it.

16. Governing law

These terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-laws rules. The state and federal courts located in Georgia have exclusive jurisdiction, and both parties consent to venue there. If any provision is held unenforceable, the rest remains in force.

17. Apple

These terms are between you and EString Software Corporation only, and not with Apple. EString Software Corporation, not Apple, is solely responsible for the AI 2nd Line app and its content. Apple has no obligation to furnish any maintenance or support for the app. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the app (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. EString Software Corporation, not Apple, is responsible for addressing any claim relating to the app, including product liability claims, claims that the app fails to conform to a legal requirement, and claims under consumer protection or similar legislation, and for the investigation, defense, settlement and discharge of any third-party claim that the app infringes intellectual property rights. You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not on any U.S. Government list of prohibited or restricted parties. You must comply with any applicable third-party terms when using the app. Apple and its subsidiaries are third-party beneficiaries of these terms and, upon your acceptance, Apple will have the right to enforce them against you as a third-party beneficiary.
